They point out that in discussions between the fields of religion and law to date, "Jewish, Muslim, Catholic, and Reformed perspectives have largely dominated" (1). In bringing Lutheran perspectives to questions of law and religion, this collection begins an important task of retrieving a theological perspective on law that was integral for the formation of modern legal thought but has been largely absent from contemporary discussions of law and religion.The strength of this collection of essays lies in the breadth of contemporary legal questions addressed and in the diversity of perspectives offered. Since, as Duty and Failinger point out, recent Lutheran scholarship has been relatively silent on questions of law and religion, there is a broad field of issues to explore. This collection avoids too narrowly focusing on any one "hot-button" issue of law and religion, such as questions of religious liberty or relationship between church and state, although these questions are addressed. Rather, it benefits from a truly expansive view of contemporary legal issues and includes essays on issues as diverse as immigration reform, family law, fiduciary duties, military chaplaincy, and water rights in the American Southwest. The collection also shows geographical breadth, and looks beyond the contemporary American and European legal arena to consider how theology could affect law in Nigeria and Rwanda. The volume also benefits from a wide range of theoretical approaches, including contributions from both legal scholars and theologians. In [End Page 211] the dialectic that results as theologians consider law and legal scholars consider theology, we see a performative example of the Lutheran concept of two kingdoms, both coexisting under God's domain.The collection would have benefited from a broader use of theological sources to accompany this admirably broad approach to legal issues. Many, although not all, of the essays, draw only on Martin Luther's understanding of Christian engagement with legal authority. This focus on Luther's somewhat limited legal corpus can result in a slightly repetitive theological approach among the essays. However, this narrow focus on Luther indicates a potential next stage for further development of Lutheran engagement with contemporary legal issues. In the closing essay in the book, "How Should Modern Lutherans Try to Shape Secular Law?," Robert Benne references John Witte's work in tracing how Philipp Melanchthon and the Lutheran jurists developed Luther's original theory of law to "build bridges between the two kingdoms" (332). While this book provides a good starting point for bringing Lutheran perspectives to bear on contemporary legal issues, it also indicates the need for future research to excavate the perspectives of Melanchthon and jurists such as Johannes Eisermann and Johann Oldendorp, along with more modern Lutheran scholars of law and religion, such as Helmut Thielicke, who considered the legacy of Lutheran legal theory in the wake of post-Nazi Germany. The Selected Works of Arne Naess, ed. by Harold Glasser and Alan Drengson in cooperation with the author, Dordrecht: Springer 2005. 10 volumes. On January 12, 2009 Norwegian philosopher Arne Naess passed away at the age of 96. He was still actively involved in putting together the edition of the Selected Writings of Arne Naess . He worte an introduction to the writings which is printed at the beginning of each volume together with the extensive introduction by the editor Harold (...) Glasser. At first sight this seems strangely repetitive and superfluous but on closer scrutiny it certainly makes sense. In view of the large breadth of philosophical themes that are presented in the volumes it is quite likely that the readers interested in the writings will come from different areas. A number of these writings make high demands on the reader who is expected to be relatively versed in logical analysis and in the work and thought of Spinoza, Kierkegaard, Gandhi, Husserl, Carnap or even Sextus Empiricus. The reader who is interested in one of these heterogenous fields is encouraged by both introductory texts to reflect on a specific theme against the backdrop of the philosophers’s entire oeuvre – and that’s a good thing. The later accretions reveal (...) much not only about changing attitudes towards the Norman invasion of England, but also about views of the early Viking foundation of Normandy. Elisabeth van Houts's two-volume edition is based on a study of all forty-seven extant manuscripts of the Gesta, including the earliest surviving copy of c. 1100, hitherto unknown. The full original text of William of Jumièges is supplied, as well as the integral text of the subsequent revisions and additions. Volume I contains Dr van Houts's introduction to the whole work, together with the text and translation of books i-iv. Books v-viii will appear in Volume II. This essay places psychiatrist and philosopher Frantz Fanon’s anti-colonial, anti-racist message from Peau Noire, Masques Blancs/Black Skin, White Masks in conversation with the new diagnoses of “Gender Dysphoria” and “Transvestic Disorder” in the fifth edition of the Diagnostic and Statistical Manual of Mental Disorders. Specifically, the essay discusses sexologist Ray Blanchard’s controversial theory of autogynephilia alongside Fanon’s ambivalent rendering of transgender desire and interracial trans phenomenology in a crucial but frequently overlooked passage in Black Skin. Fanon’s anti-colonial critique of psychiatry (...) allows us to reconsider how Blanchard’s theories on paraphilia engage with the foundational psychoanalytic concepts of identification and desire, as identified by the Freudian and Lacanian models and explored in the writings of Judith Butler, Catherine Millot, Charles Shepherdson, and others. By offering a fresh interpretation of the French text, this essay argues that a “trans of color critique” can benefit from Black Skin’s unexpected insight into trans desire: Fanon’s “man of color,” who simultaneously undergoes a gender transition and a racial transformation, represents the literal embodiment of his critique of colonial racism. Given the role of the new paraphilias in the DSM-V, this essay concludes that a trans of color critique is well positioned to reinforce the anti-colonial message Fanon addressed to the psychiatric and psychoanalytical fields, which have tended to diagnose psychic injury while ignoring its causation, and which continue to neglect the fact that medical access is just as important as material support and security for minority subjects, in particular. In 1885, the Austrian music critic and scholar Friedrich von Hausegger published his book “Die Musik als Ausdruck” (“Music as Expression”) which may be understood as an answer to Eduard Hanslick’s “Vom Musikalisch-Schönen” (“On the Musically Beautiful”, 1854). Unlike Hanslick, Hausegger takes the body as central to any adequate account of music. Hence Charles Darwin’s theory of evolution, in particular his book “The Expression of Emotions in Man and Animals” (1872), becomes a central reference for Hausegger. His treatise is a (...) detailed and systematic reconstruction of the probable development of musical expression. This article consists of three sections: the first sketches the development of calculating the timing of the New Moon from biblical times onward with special emphasis on the Byzantine/Romaniote communities; the second contains the critical edition of the announcement of the New Moon from four late medieval manuscripts, where the Judaeo-Greek text complements the Aramaic version of this announcement that was recited in Romaniote synagogues; and the third presents a philological commentary on the Judaeo-Greek version/versions of this announcement. Its main (...) goal is to place the language of the announcement, that is unique for its use of the vernacular, in the context of Byzantine vernacular literature, which has primarily been preserved in poetry. While substantial differences exist between the two versions identified by the authors, the Aramaic and the Greek texts both strive to create the impression of great antiquity through the use of images associated with the Temple and by linguistic means. Dating these texts earlier than the eighth century is unlikely, though, and the Greek text does not permit a terminus ante quem. Considering its thematic content and the use of archaic language(s) as constituens textus, which can run counter to a certain modernization, we may understand this decision as symbolic act by the Romaniotes to push their claim of diaspora ancestry reaching back to Late Antiquity or possibly the Second Temple Period. Another significant strand that can be discerned in the Greek version is the strong Byzantine background being evoked for its intended audience. Through their deliberate effort to archaise their origins, the Romaniote Jews, like their Christian neighbors, display Ancient Greek as a symbol of their identity. (shrink)

Analytic philosophy - arguably the most important philosophical movement in the 20th century - has gained a new historical self-consciousness, particularly about it's own origins. The period between 1880 and 1930 saw the most important work of its founding figures (Frege, Russell, Moore, Wittgenstein) take root and flourish. Liberty is an expanded edition of Isaiah Berlin's classic of liberalism, Four Essays on Liberty. Berlin's editor Henry Hardy has incorporated a fifth essay, as Berlin wished, and added further pieces on the same topic, so that Berlin's principal statements on liberty are available together for the first time. He also describes the gestation of the book and throws further biographical light on Berlin's preoccupation with liberty in appendices drawn from his unpublished writings.
